Abstract

State social policy is designed to create conditions for the realization of the rights of the most vulnerable categories of citizens. The right to education, enshrined in the Constitution of the Russian Federation and concretized in educational legislation, will remain a declaration without an effective implementation mechanism in place. One element of this mechanism should be the creation of an accessible environment that ensures that persons with disabilities have the same educational opportunities as other citizens. Education as a subject of this study has been considered in the context of the definition of guarantees of accessibility for children with disabilities. The category of access to education is becoming a fundamental principle of modern State educational policy. There is also a need to consider the right to an accessible environment as an autonomous right, which is growing in importance in the context of the formation of the social State, and to examine institutional strategies for its protection. The purpose of the study is to determine the place and significance of the institution of children’s rights commissioners in the mechanism for the protection of the right to an accessible environment in the field of education, and to identify common and specific aspects of their activities. Using a comparative-­legal method of research, the article considers the practice of ensuring the right to an accessible environment by children’s rights commissioners in the constituent entities of the Russian Federation that are part of the Southern Federal District. The study resulted in recommendations to improve the mechanism for the realization of the right to education for persons with special needs in the constituent entities of the Russian Federation. The Commissioner for the Rights of the Child, as a special legal mechanism for the protection of the rights and legitimate interests of minors, was found to have considerable potential in ensuring the right to an accessible environment.
